James P. Shinehouse
Jim is a Partner at Atlantic Financial Advisory Partners which was formed in early 2009 through a management buyout of Kroll Talbot Hughes where he was a Managing Director since 2005. Jim has over 25 years of hands-on crisis management experience and has handled difficult corporate restructurings and workouts for international clients. Jim has also conducted numerous complex fraud investigations during that time.
Jim primarily focuses on assisting stressed or distressed businesses both in the United States and abroad. In those roles, Jim serves as CEO, chief restructuring officer (CRO), director or receiver representative to operate, restructure and/or liquidate troubled businesses. In addition, he has conducted numerous complex forensic accounting investigations and managed more than 100 varied litigation projects. Jim has regularly been hired by counsel and the Justice Department in the capacity of an expert witness.
Jim has headed investigations into many significant forensic accounting assignments. He was selected by the US Department of Justice to lead the Kroll team as the court appointed Receiver and forensic accountant on the $500 million Bayou Hedge Fund matter. Jim also led the investigation into the $1.1 billion international fraud at UK based Ferranti and the fraud investigation in the $800 million Le Natures case. Jim was also hired as an expert to support the largest lender group in their litigation against Enron.
During his time at Kroll, Jim served as the Global Practice Leader of the Financial Advisory Services Group. Prior to joining Kroll, Jim was U.S. practice head for Talbot Hughes McKillop, which was acquired by Kroll in 2005. He was previously a retained consultant for Arthur Andersen’s London based restructuring practice and served as CEO of Ferranti International in the United States. Jim also spent six years in the audit practice at KPMG. A certified public accountant, Jim has taught accounting and fraud examination courses at Franklin & Marshall College and West Chester University.
Jim currently serves on various charitable and not-for-profit boards of directors including The Gemology Institute of America (Vice Chair of the Board and Audit Committee Chair), The West Chester University Foundation (Past President), Legacy Youth Tennis and Education, and the Domestic Violence Center of Chester County (President).
Representative Experience
- Corporate Restructuring . Director of a £1 Billion UK electrical retailer’s holding company. Responsible for lending, corporate governance, and oversight of operational restructuring matters. Jim is also a Director of an affiliated Curaçao-based insurance company.
- Corporate Restructuring . Director of a UK based £500 Million video game retailer’s holding company. Responsible for lending, corporate governance, and oversight of operational restructuring matters.
- Financial and Business Investigation. An investor group appointed Jim and his firm to investigate and evaluate the operations and financial affairs of a major entertainment media company.
- Interim Management. Chief Executive Officer of two $1 Billion Channel Island infrastructure investment funds traded on the Vienna public market. Responsible for supervising a team of portfolio managers, overseeing the operations of the investment assets, pursuing litigation related to alleged fraud against the funds, and managing the process of an orderly disposal of the investments and final wind up of the funds.
- Financial Restructuring and Financial Investigation. Jim led Kroll as court appointed receiver and forensic accountant to the U.S. Department of Justice in the $500 million Bayou hedge fund matter.
- Corporate Restructuring. Appointed by U.S. Bankruptcy Court and approved in the CCAA proceedings as Chief Restructuring Officer of the debtor in possession in the Chapter 11 proceedings of Pope & Talbot, a NYSE listed producer of lumber and pulp products with operations in the U.S. and Canada.
- Financial Restructuring. As director and plan administrator, Jim oversaw the $450 million restructuring and insolvency of Swiss Air Finance.
- Financial Restructuring. Jim was an advisor to Le Meridien Hotel Group in their financial restructuring of over £2.2 billion in debt, particularly with respect to the North American based operations and assets.
- Forensic Accounting. A creditor group appointed Jim as financial advisor and forensic accountant in its $358 million constructive trust claim against Enron.
- Financial Restructuring and Fraud Investigation. Jim directed and managed the investigation and surrounding litigation of a $1.14 billion financial and international contract fraud, including a $958 million international money laundering scheme. As part of the company’s subsequent worldwide receivership, Jim continued as CEO with the additional role of CRO to direct the divestiture of the company’s US operations and assets.
- Financial Restructuring. Jim was advisor to Marconi’s U.K. parent company in its $9 billion restructuring regarding its U.S. operations.
- Financial Restructuring. Jim directed the U.S. restructuring of Transtec, NSM, Ferranti, USM and Photobition, among others, including the divestiture of over 100 businesses.
